Cam-Shot Purchaser Policy

Important: This document is intended for platform use and should be read together with Cam-Shot's main Terms of Use, Privacy Policy, and operational payout/settlement terms, if applicable.

1. Scope and Acceptance

This Purchaser Policy applies to every person or entity that browses, selects, pays for, downloads, accesses, or uses digital photographs, albums, or related digital image content through Cam-Shot ("Purchaser"). By purchasing through Cam-Shot, the Purchaser agrees to this Purchaser Policy, the Cam-Shot Terms of Use, Privacy Policy, and any seller-specific conditions validly displayed on the relevant gallery, collection, listing, or checkout flow.

2. Identity of Platform Operator

Cam-Shot is a technology platform owned and operated by Cambiante Technologies Private Limited, Jaipur, Rajasthan, India. Cam-Shot provides the platform infrastructure through which Sellers may display and sell digital photographs and through which purchasers may make payments and obtain digital access.

3. Role of Cam-Shot

Cam-Shot is only a technology platform and payment facilitation layer. Cam-Shot is not the photographer, copyright owner, editor, publisher, reseller, or warrantor of the content unless expressly stated otherwise in writing. Cam-Shot does not independently verify the identity of Sellers, ownership of content, quality of photographs, legal permissions, or accuracy of descriptions.

4. Nature of Purchase

When a Purchaser buys a digital photo through Cam-Shot, the Purchaser receives digital delivery access and a limited usage right only. Copyright and all related proprietary rights remain with the Seller or the applicable rights holder unless expressly transferred in writing. A purchase through Cam-Shot does not by itself transfer copyright, commercial usage rights, or unrestricted exploitation rights.

5. Default Usage License

  • Unless the Seller expressly grants broader rights in writing, the Purchaser receives only a limited, revocable, non-exclusive, non-transferable, non-sublicensable license for personal and private use.
  • The Purchaser may download, store, view, and privately share the purchased photo for non-commercial personal purposes only.
  • The Purchaser shall not resell, sublicense, redistribute, commercially exploit, publicly publish for commercial use, use for advertising, marketing, merchandise, stock use, AI training, model training, or otherwise exploit the content beyond the limited license granted.
  • The Purchaser shall not remove watermarks, alter attribution, misrepresent authorship, or use the content in any unlawful or rights-infringing manner.

6. Seller-Specific Terms

Some galleries or photos may be subject to additional seller-specific terms, restrictions, or scope of usage. The Purchaser is responsible for reviewing and complying with any such validly communicated terms. Where valid seller-specific terms impose greater restriction than the default license, the more restrictive term shall apply unless the Seller clearly states otherwise.

7. Pricing and Payment

Prices are determined by the Seller. Cam-Shot may collect payment using third-party payment processors on behalf of the Seller. The Purchaser is responsible for ensuring that all payment information used is accurate, authorized, and lawful. Cam-Shot may refuse, suspend, or cancel a transaction where it suspects fraud, unauthorized activity, pricing error, payment failure, technical error, policy breach, or legal risk.

8. No Refunds

All purchases made through Cam-Shot are final and non-refundable. Because the products sold through the platform are digital goods that may be instantly accessed, viewed, or downloaded, no refund, return, cancellation, exchange, or credit shall be available after purchase, whether or not the content has been downloaded, except where required by applicable law or where Cam-Shot elects otherwise in its sole discretion. The Purchaser shall not initiate abusive or improper chargebacks after obtaining access, except in cases of genuine unauthorized transactions or as otherwise permitted by law.

9. Delivery and Access

Cam-Shot provides the technical mechanism through which purchased digital content may be delivered to the Purchaser, including by means of download access, access link, gallery access, or account-based access. However, Cam-Shot does not control and is not responsible for the Seller's decision to continue publishing, maintaining, or making such content available on the platform. If the Seller removes, unpublishes, deletes, disables, restricts, or otherwise withdraws the content, gallery, collection, or listing before the Purchaser downloads the purchased content, Cam-Shot shall have no liability for non-delivery, failed access, loss of access, or inability to re-download such content. The Purchaser is responsible for promptly downloading and securely storing purchased content once access is made available. Cam-Shot does not guarantee permanent hosting, permanent backup, archival retention, uninterrupted availability, or ongoing re-download rights unless expressly committed in writing.

10. Quality, Suitability, and Seller Disputes

All concerns relating to artistic style, editing quality, photo selection, event coverage, angle, lighting, completeness, subjective dissatisfaction, personal appearance, or creative expectations are matters between the Purchaser and the Seller. Cam-Shot is not responsible for dissatisfaction arising from creative or subjective expectations and does not guarantee that any photograph will meet the Purchaser's personal preferences.

11. Prohibited Conduct by Purchaser

  • Copying, scraping, bulk-downloading, redistributing, or commercially using content without authorization.
  • Bypassing watermarks, access controls, payment mechanisms, or platform protections.
  • Using purchased photos in violation of law, third-party rights, or the limited license granted.
  • Using bots, scripts, or other technical means to obtain unauthorized access to galleries, files, or accounts.

12. Intellectual Property and Complaint Handling

If a Purchaser believes that content available through Cam-Shot violates rights or is otherwise unlawful, the Purchaser may notify Cam-Shot with sufficient details. Cam-Shot may remove access, disable content, seek information, or disclose relevant information where legally required or reasonably necessary. Cam-Shot is not obligated to adjudicate private disputes between Purchasers and Sellers.

13. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Cam-Shot provides the platform on an "as is" and "as available" basis without warranties of title, merchantability, fitness for purpose, non-infringement, uninterrupted access, or suitability. Cam-Shot shall not be liable for indirect damages, incidental damages, punitive damages, special damages, consequential damages, emotional dissatisfaction, loss of opportunity, or loss of data arising out of use of the platform or purchase of digital photos. The aggregate liability of Cam-Shot in connection with any purchaser claim shall not exceed the platform fees actually retained by Cam-Shot from the specific disputed transaction, or INR 5,000, whichever is lower.

14. Indemnity by Purchaser

The Purchaser shall defend, indemnify, and hold harmless Cam-Shot, Cambiante Technologies Private Limited, and their affiliates, directors, officers, employees, contractors, service providers, and agents from and against all claims, liabilities, losses, damages, costs, and expenses including legal fees arising from misuse of purchased photos, breach of the usage license, unlawful publication, abusive chargebacks, fraud, or breach of this Purchaser Policy.

15. Suspension and Access Restriction

Cam-Shot may restrict access, disable downloads, suspend accounts, or cancel access where it suspects fraud, unauthorized access, abusive conduct, misuse of content, security risk, or policy breach.

16. Governing Law and Jurisdiction

This Purchaser Policy shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction in relation to any dispute, claim, or proceeding arising out of or relating to this Purchaser Policy, the use of Cam-Shot, or any purchase made through the platform.

17. Policy Updates

Cam-Shot may modify this Purchaser Policy at any time. The updated version shall become effective upon publication on the platform or upon other notice by Cam-Shot. Continued use of the platform after such update shall constitute acceptance of the revised policy.
