Important: This document is intended for platform use and should be read together with Cam-Shot's main Terms of Use, Privacy Policy, and operational payout/settlement terms, if applicable.

1. Scope and Acceptance

This Seller Policy applies to every studio, photographer, event manager, organizer, agency, individual, firm, or other person or entity using Cam-Shot to upload, display, market, license, or sell digital photographs, albums, or related digital image content through the platform ("Seller"). By using Cam-Shot for sale of digital content, the Seller agrees to be bound by this Seller Policy, the Cam-Shot Terms of Use, Privacy Policy, payout and settlement rules, and any additional operational guidelines or commercial terms notified by Cam-Shot from time to time.

2. Identity of Platform Operator

Cam-Shot is a technology platform owned and operated by Cambiante Technologies Private Limited, a company based in Jaipur, Rajasthan, India. Cam-Shot provides software, hosting, payment facilitation, access control, and digital delivery tools that enable Sellers to offer digital content to purchasers.

3. Role of Cam-Shot

Cam-Shot acts only as a technology platform and limited payment collection and settlement facilitator. Cam-Shot is not the creator, commissioner, copyright owner, publisher, merchant of record, reseller, or legal licensor of Seller content unless expressly agreed by Cambiante Technologies Private Limited in writing. Cam-Shot does not independently verify the ownership, originality, legality, quality, permissions, releases, pricing, or suitability of any content uploaded by a Seller.

4. Seller Responsibility

  • The Seller is solely responsible for all content uploaded, displayed, offered, licensed, or sold through Cam-Shot, including photographs, previews, metadata, descriptions, captions, watermarks, tags, pricing, and access rules.
  • The Seller must obtain and maintain all rights, licenses, permissions, approvals, releases, and consents required for photographing, uploading, publishing, licensing, and selling such content.
  • The Seller is solely responsible for ensuring that the content and its sale do not violate any applicable law, contract, privacy right, publicity right, copyright, trademark, confidentiality obligation, venue restriction, institutional rule, or third-party right.
  • The Seller is solely responsible for all taxes, invoicing, GST, levies, duties, reporting obligations, and statutory compliance applicable to its sales and business activities.

5. Seller Representations and Warranties

  • The Seller has full legal authority to use Cam-Shot and to enter into binding obligations.
  • The Seller owns, controls, or has valid authorization over all rights necessary to upload, display, license, and sell the content.
  • The content does not infringe, misappropriate, or violate any intellectual property right, privacy right, publicity right, moral right, confidentiality obligation, or other right of any third party.
  • All necessary subject consents, model releases, parental permissions, event permissions, organizer permissions, venue permissions, and institutional approvals have been obtained wherever applicable.
  • The content is not unlawful, fraudulent, defamatory, obscene, exploitative, misleading, or otherwise prohibited by law or policy.

6. Prohibited Content and Conduct

  • Content that infringes third-party rights or is uploaded without necessary authorization.
  • Content that violates privacy, confidentiality, court orders, or legal restrictions.
  • Content involving fraud, impersonation, malware, phishing, or deceptive conduct.
  • Any content that is illegal, abusive, hateful, sexually unlawful, exploitative, defamatory, or otherwise objectionable.
  • Any use of the platform intended to circumvent payment, access control, watermarking, or other platform protections.

7. Listing, Pricing, and Licensing

The Seller is solely responsible for deciding which content is offered for sale, the price at which it is offered, whether previews are visible, whether watermarking is applied, and whether any seller-specific license terms are communicated. Unless the Seller expressly provides broader rights in writing, the sale of a photograph through Cam-Shot shall be treated as a limited personal-use license to the purchaser and not as a transfer of copyright.

8. Payment Collection, Settlement, and Deductions

Cam-Shot may collect money from purchasers on behalf of the Seller, deduct platform fees, payment gateway charges, taxes, reserves, reversals, chargebacks, offsets, penalties, and any other sums payable by the Seller to Cam-Shot, and thereafter settle the balance to the Seller periodically. Settlement timelines are indicative only and may vary due to reconciliation, risk review, reserves, chargebacks, technical issues, banking delays, legal holds, compliance checks, or holidays. Cam-Shot may withhold, defer, or adjust settlements whenever reasonably required for risk management or legal compliance.

9. No Refunds; Reversals Still Allowed

The Seller acknowledges that Cam-Shot operates on a no-refund basis for digital photo sales except where a refund is required by applicable law or is otherwise issued at Cam-Shot's sole discretion for operational, fraud, legal, regulatory, or customer-resolution reasons. The Seller further acknowledges that the absence of a refund policy does not prevent chargebacks, card disputes, payment reversals, banking reversals, regulatory reversals, or court-directed reversals, and the Seller remains fully liable for all such amounts.

10. Seller Content Availability Obligation

The Seller acknowledges that purchaser access to purchased content depends upon the Seller continuing to keep the relevant content, gallery, collection, or listing published and available on the platform. If the Seller removes, unpublishes, deletes, disables, restricts, or otherwise withdraws purchased content before the purchaser has had a reasonable opportunity to download it, Cam-Shot shall have no liability to the purchaser or to the Seller for such non-availability. The Seller shall remain solely responsible for any complaint, claim, dispute, chargeback, reversal, cost, or commercial consequence arising from such removal or unavailability.

11. Intellectual Property License to Cam-Shot

The Seller retains ownership of Seller content. However, the Seller grants Cam-Shot and Cambiante Technologies Private Limited a worldwide, non-exclusive, royalty-free, sublicensable, revocable license for the duration reasonably necessary to host, store, process, compress, watermark, display, transmit, promote, secure, deliver, and otherwise use the content for operation, support, enforcement, troubleshooting, and improvement of the platform and for facilitating digital sales.

12. Takedowns, Complaints, and Enforcement

If Cam-Shot receives any complaint, notice, claim, legal demand, police request, court order, regulatory direction, rights assertion, or other allegation relating to Seller content or Seller conduct, Cam-Shot may without prior notice remove or disable content, suspend access, hold settlements, request documents, disclose relevant information where legally required or reasonably necessary, or terminate the Seller account. Cam-Shot is not obligated to adjudicate ownership disputes or to keep content available pending resolution.

13. Indemnity

The Seller shall defend, indemnify, and hold harmless Cam-Shot, Cambiante Technologies Private Limited, and their affiliates, directors, officers, employees, contractors, service providers, and agents from and against all claims, actions, proceedings, losses, damages, liabilities, fines, penalties, taxes, chargebacks, reversals, costs, and expenses including legal fees arising out of or relating to Seller content, missing permissions, infringement claims, privacy or publicity claims, unlawful conduct, tax non-compliance, misleading listings, breach of this policy, or any act or omission of the Seller.

14. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Cam-Shot shall not be liable for loss of profits, loss of opportunity, loss of goodwill, indirect damages, incidental damages, special damages, punitive damages, or consequential damages, or for claims arising from content ownership disputes, permissions, legality, purchaser misuse, piracy, payment failures, gateway downtime, banking delays, settlement delays, or seller-side removal of content. The aggregate liability of Cam-Shot in relation to Seller photo sale services shall not exceed the platform fees actually retained by Cam-Shot from the specific disputed transaction or transactions giving rise to the claim during the preceding three months, or INR 10,000, whichever is lower.

15. Suspension and Termination

Cam-Shot may suspend, restrict, delist content, hold payouts, or terminate a Seller account immediately, with or without notice, if it suspects fraud, rights violations, excessive disputes, unlawful activity, policy breach, security risk, or reputational risk. Cam-Shot may continue to hold amounts reasonably necessary after suspension or termination to cover disputes, reversals, reserves, legal risk, or potential liabilities.

16. Governing Law and Jurisdiction

This Seller Policy shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction in relation to any dispute, claim, or proceeding arising out of or relating to this Seller Policy, the use of Cam-Shot, or the sale of content through the platform.

17. Policy Updates

Cam-Shot may modify this Seller Policy at any time. The updated version shall become effective upon publication on the platform or upon other notice by Cam-Shot. Continued use of the platform after such update shall constitute acceptance of the revised policy.
